Bail and Bondsman

Bail is the temporary release of an accused person from jail as they await their trial on the condition that money be pledged to the court to ensure their appearance at their trial. If the individual violates the condition of the court, the pledged money is forfeit.

A bondsman is an individual who acts as a surety, pledging the bail amount to the court, for an accused individual who is unable to post bail. If the individual fails to appear before the court at his trial, the bondsman will have to pay the full bail amount. For his services, the bondsman will charge a non-refundable fee, typically 10% of the bail amount. The defendant must also put down collateral for the rest of the bond.
